How the Ohio Healthcare Amendment Protects us from Mandatory Vaccines and Mandatory Testing.

Ohio’s public healthcare “program” is often referred to as Ohio’s Public Healthcare system. It is a system put in place to protect Ohioans - against their will if necessary. This “system” distinction is important in determining what the State can and cannot do on a legal basis.

Amy Acton is, in times of a declared health emergency, in charge of Ohio’s Public Health and the “system” that would compel Ohioans to comply.

In 2011 the Ohio State Constitution was amended with the Ohio Healthcare Freedom Amendment. It states:
 §21 (A) No federal, state, or local law or rule shall compel, directly or indirectly, any person, employer, or health care provider to participate in a health care system.

And “Health care system” and “Compel” is defined in the Ohio Constitution.

(1) “Compel” includes the levying of penalties or fines.

(2) “Health care system” means any public or private entity or program whose function or purpose includes the management of, processing of, enrollment of individuals for, or payment for, in full or in part, health care services, health care data, or health care information for its participants.

According to the Ohio Constitution - this means that the state of Ohio cannot pass any law that mandates testing, or mandates vaccines. This does not prevent employers from having the freedom to voluntarily mandate testing or mandate vaccines as a condition of employment.

Legal experts are also trying to determine that if compelling a business to close during the time of a health emergency is legal. Would this be part of “health care services”? Many legal experts believe it would be. So compelling an employer to shutdown because of public health concerns would be in opposition to the Ohio Healthcare Amendment.

This also means that a testing requirement program for employment re-entry would be wholly illegal. Federal and State and local law cannot compel this participation.
